Robert Tracy Discussses Dress Code Discrimination in New York Law Journal

Robert Tracy co-authored the article “Are dress codes and grooming policies a source of potential liability for employers?” for the New York Law Journal’s Fashion Law issue published on August 26, 2019. Recently, state and local governments have passed new laws and increased enforcement of existing laws to protect employees from discrimination based on race or gender identity or expression in the workplace. In the article, they review the new guidance and discuss best practices for employers to update their dress and grooming policies and practices.

Bob Tracy Talks with Women’s Wear Daily about Workplace Antidiscrimination and Personal Expression

Labor and Employment Partner Bob Tracy was quoted in the Women’s Wear Daily article “On Staff: Fashion Works Through Braids and Identity.” The article explores steps that the New York City Commission on Human Rights has taken to identify potentially discriminatory practices involving grooming standards and dress codes.

Bob notes the importance of fashion companies reviewing their practices and policies on personal grooming standards and dress codes in light of the rent enforcement guidance from New York City applying the city’s law against racial discrimination to workplace restrictions on some hair styles and textures as well as prior enforcement guidance from New York City applying gender discrimination law to dress codes that may adhere to gender specific stereotyping.

Immigration Partners Ellen Poreda and Stephen Maltby co-authored the United States chapter of The Corporate Immigration Review.

The chapter provides an introduction to the U.S. immigration framework including legislation and policy, international treaty obligations, employer sponsorships and visas for investors, skilled migrants and entreprenuers. The chapter also includes a year in review.

Immigration Attorney David W. Johnson Promoted to Partner

Prior to joining Gibney in 2009, David served as an Immigration Attorney with the Staff Attorneys’ Office of the United States Court of Appeals for the Second Circuit.

Brian Brokate and Maja Szumarska Co-author Article on Ex Parte Seizure Orders

IP attorneys Brian Brokate and Maja Szumarska co-authored the article “Ex Parte Seizure Orders Under 15 U.S.C. § 1116(d) (Section 34 of the Lanham Act): Recent Developments in Case Law.” The article was published in the May–June 2018 issue of The Trademark Reporter. The article provides a summary of recent counterfeiting cases and highlights the need to adhere closely to the statutory requirements when seeking ex parte seizure relief. The Trademark Reporter is the law journal of the International Trademark Association. It is a peer-reviewed academic journal dedicated to trademark law and related topics under U.S. and international law.

Brian Brokate is head of Gibney’s Intellectual Property Practice Group. He has extensive experience in trademark and copyright enforcement procedures to combat infringement and counterfeiting. Maja Szumarska concentrates on intellectual property protection and enforcement actions in federal court.
