Immigration Attorney David W. Johnson Promoted to Partner

Gibney is pleased to announce that David W. Johnson has been promoted to Partner.

As an attorney in Gibney’s Immigration Group, David assists corporate and individual clients in immigrant, nonimmigrant, and citizenship matters and provides advice on immigration-related onboarding compliance issues.

The Emerging Business Group provides U.S. immigration and global mobility services for entrepreneurs, start-ups, established businesses and their employees. David helps to guide entrepreneurs through all stages of the start-up process including advising on immigration and connecting businesses with the firm’s other practice areas to provide advice on business formation and qualification, intellectual property, employment, real estate, and tax.

Prior to joining Gibney in 2009, David served as an Immigration Attorney with the Staff Attorneys’ Office of the United States Court of Appeals for the Second Circuit.

Brian Brokate and Maja Szumarska Co-author Article on Ex Parte Seizure Orders

IP attorneys Brian Brokate and Maja Szumarska co-authored the article “Ex Parte Seizure Orders Under 15 U.S.C. § 1116(d) (Section 34 of the Lanham Act): Recent Developments in Case Law.” The article was published in the May–June 2018 issue of The Trademark Reporter. The article provides a summary of recent counterfeiting cases and highlights the need to adhere closely to the statutory requirements when seeking ex parte seizure relief. The Trademark Reporter is the law journal of the International Trademark Association. It is a peer-reviewed academic journal dedicated to trademark law and related topics under U.S. and international law.

Brian Brokate is head of Gibney’s Intellectual Property Practice Group. He has extensive experience in trademark and copyright enforcement procedures to combat infringement and counterfeiting. Maja Szumarska concentrates on intellectual property protection and enforcement actions in federal court.

Stephen Maltby and David Johnson Co-author Article on Doing Business in the U.S.

Immigration Partners Stephen Maltby and David Johnson co-authored an article in the Trade and Investment Guide to the US for BrtishAmerican Business. The publication was launched at the BABC Conference in Birmingham, United Kingdom on June 6.

The Annual Transatlantic Business Conference brings together 300 Senior Executives throughout the U.S. and U.K. for a 2-day program of high-level business discussions and networking with business executives actively involved in transatlantic business.

The article addressed key immigration issues for foreign businesses looking to establish or grow their presence in the United States, including common nonimmigrant visa categories and business planning best practices.

Gibney Attorneys Author Article on Executive Transfers to the United States

Gerald J. Dunworth, Meredith M. Mazzola  and Shai Dayan co-authored the article “Executive transfers to the United States: planning and avoiding pitfalls.” The article looks at the main considerations when an executive is transferred to the US, including global compensation packages, securing visas for executives and their spouses, tax planning, retirement benefits, housing costs, expat protection, permanent residence and repatriation. The article appears in Practical Law’s Private Client Guide.

Houman Afshar Quoted in Bloomberg BNA on Trump Immigration Order

Immigration Partner Houman Afshar was quoted in the Bloomberg BNA article “How Hard Will Trump’s Immigration Order Hit Businesses?” on January 31, 2017. The article addresses how U.S. companies are responding to President Donald Trump’s Jan. 27 immigration executive order which included a ban on entry for nationals of Iran, Iraq, Libya, Somalia, Sudan, Syria, and Yemen.  Houman noted that the “situation is very volatile, very fluid, and it seems to be changing every couple of hours” and that it’s created a challenge for corporate America. The article addresses how the travel ban is impacting U.S. business and the uncertainty at the moment with how it is being implemented.
