After September 11, 2001 virtually all companies increased their emphasis on disaster recovery plans for their facilities.  Many companies have also implemented executive protection plans that provide personal physical security for their top executives due to criminal/terrorist activity, car accidents and serious illness.  If any of these events happen to an executive in a foreign jurisdiction, the consequences to the executive and his or her spouse or family can be particularly complex and stressful.  If the unexpected emergency involves the executive’s spouse or children, it can be more than distracting for the executive, and his or her business may suffer.

Gibney has developed a program to help companies prepare their executives for these contingencies.  From a legal perspective, if the executive has certain documents in place and has taken certain key steps to organize his or her affairs in the event of an emergency, unnecessary delays and expenses can be avoided. If it is the executive that has the emergency, the company’s involvement is likely to be streamlined and reduced in attending to the family issues. If it is the executive’s family that has the emergency, proper planning will facilitate the executive’s return to work. Both situations enhance the executive’s peace of mind and the attractiveness of the overseas assignment.
